Scope<\/h2>\n<p>1.1 These General Terms and Conditions (GTC) apply to all contracts between <strong>myParkplace GmbH<\/strong>, Flohrstr. 19, 13507 Berlin, Germany (hereinafter <strong>\u201emyParkplace\u201c<\/strong>) and its customers regarding the use of parking spaces, shuttle services, and other services offered by myParkplace.<\/p>\n<p>1.2 myParkplace's offering is aimed at both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity (\u00a7 13 BGB). A business is any natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when entering into the contract (\u00a7 14 BGB).<\/p>\n<p>1.3 Deviating, conflicting or supplementary terms and conditions of the customer shall not become part of the contract, unless myParkplace expressly agrees to their validity in writing.<\/p>\n<p>&nbsp;<\/p>\n<h2>2. Subject Matter of the Contract<\/h2>\n<p>2.1 myParkplace offers customers the opportunity to park vehicles on myParkplace's premises near the airport for a fee.<\/p>\n<p>2.2 Depending on the booked tariff or offer, a shuttle transfer between the myParkplace premises and Berlin Brandenburg Airport (BER) can be part of the service offering.<\/p>\n<p>2.3 The subject of the contract is primarily <strong>the chargeable letting of a parking space<\/strong> for a motor vehicle, as well as \u2013 if booked or included in the tariff \u2013 the transport of the customer and registered fellow travellers as part of the shuttle service.<\/p>\n<p>2.4 <strong>Not the subject of the contract<\/strong> is the safekeeping or guarding of the vehicle, unless expressly agreed otherwise. myParkplace owes the provision of a parking space and \u2013 if agreed \u2013 the carrying out of the shuttle service, but not any further care in the sense of a safekeeping contract.<\/p>\n<p>&nbsp;<\/p>\n<h2>3. Conclusion of contract \/ Booking<\/h2>\n<p>3.1 Bookings can be made in particular via the myParkplace website, via the booking system integrated there, by telephone, by e-mail or via intermediary platforms.<\/p>\n<p>3.2 Upon completion of the booking process, the customer submits a binding offer to conclude a contract.<\/p>\n<p>3.3 The contract is concluded as soon as myParkplace or the booking system used by myParkplace confirms the booking or sends the customer a booking confirmation.<\/p>\n<p>3.4 When booking through intermediaries or partner platforms, the booking and payment terms of the respective intermediary shall apply in addition, insofar as they concern the relationship between the intermediary and the customer. The contractual relationship for the parking space and shuttle service itself comes into being \u2013 unless otherwise indicated in individual cases \u2013 between the customer and myParkplace.<\/p>\n<p>3.5 The customer is obliged to provide complete and truthful information during the booking process, in particular regarding:<\/p>\n<ul>\n<li>Name and contact details,<\/li>\n<li>Arrival and return dates,<\/li>\n<li>Flight and\/or return information, as requested,<\/li>\n<li>Vehicle data,<\/li>\n<li>Number of passengers travelling.<\/li>\n<\/ul>\n<p>3.6 The customer is obliged to inform us immediately of any changes, in particular regarding return times, flight numbers, flight cancellations, flight rebookings or delayed returns.<\/p>\n<p>3.7 With a valid booking, only <strong>A single entry and a single exit<\/strong> Permitted. An intermediate exit with subsequent re-entry based on the same booking is excluded.<\/p>\n<p>3.8 Once the customer leaves the operational premises, the respective booking is considered terminated. There is no entitlement to re-enter, further use of the parking space, or a pro-rata refund for any unused remaining time, unless expressly agreed otherwise or mandated by compulsory legal provisions.<\/p>\n<p>&nbsp;<\/p>\n<h2>4. Scope of Services<\/h2>\n<p>4.1 <strong>Parking space<\/strong><br \/>\nmyParkplace provides the customer with a parking space for a vehicle for the agreed period. A claim to a specific parking space only exists if this has been expressly agreed.<\/p>\n<p>4.2 <strong>Shuttle Service<\/strong><br \/>\nAs far as is included in the booked tariff or expressly agreed upon, the service includes a shuttle transfer from the myParkplace premises to Berlin Brandenburg Airport (BER) and a shuttle transfer back from the airport to the premises.<\/p>\n<p>4.3 <strong>Eligible persons \/ scope of shuttle service<\/strong><br \/>\nA claim to the shuttle service included in the tariff is only valid for the customer and travelling companions registered during the booking. Unless otherwise specified in the booked tariff, the shuttle service is <strong>free for up to four people per booking<\/strong>. An additional charge may apply for extra persons. The amount of the respective surcharge is shown on the booking form or the tariff booked.<\/p>\n<p>Persons not included in the respective booking or not properly stated in the booking process are not entitled to transport. myParkplace is entitled to refuse transport to unregistered or unauthorised persons or \u2013 if operationally possible \u2013 to carry them out only for an additional fee.<\/p>\n<p>4.4 <strong>Baggage \/ Oversized baggage \/ Special baggage<\/strong><br \/>\nmyParkplace is generally prepared, per customer or per travelling person, up to <strong>two medium-sized pieces of luggage<\/strong> to be transported within the limits of available shuttle space.<\/p>\n<p> <strong>Restricted baggage, special baggage or oversized baggage<\/strong> \u2013 particularly, for example, surfboards, sports equipment, golf luggage, prams of a significant size, or other bulky items \u2013 must <strong>stated in the booking process or in advance to myParkplace and booked or registered accordingly<\/strong> will be, provided there is a selection option for this in the booking system.<\/p>\n<p>If oversized or special baggage is not registered in advance and the customer arrives with such baggage, there is <strong>no claim for the carriage of this luggage or for the shuttle transfer to be carried out in the originally expected form<\/strong>. myParkplace will decide based on availability, space capacity, and operational feasibility whether and under what conditions a take-along is possible. A separate fee may apply for this.<\/p>\n<p>4.5 <strong>Third-party execution<\/strong><br \/>\nmyParkplace is entitled to provide shuttle services in whole or in part through commissioned third-party companies (e.g. taxi or car rental companies), provided that this does not incur any additional costs for the customer.<\/p>\n<p>4.6 <strong>Driver transfer on return<\/strong><br \/>\nIn exceptional circumstances, particularly during periods of high transfer volumes, myParkplace reserves the right to initially transport only the driver of the parked vehicle back to the premises. This is to ensure a faster process for all customers. There is no entitlement to the simultaneous return transport of all accompanying passengers on the same journey.<\/p>\n<p>&nbsp;<\/p>\n<h2>5. Customer's Duty to Co-operate<\/h2>\n<p>5.1 The customer is obliged to arrive at the myParkplace premises on time. Arrival or lead times mentioned by myParkplace are recommendations and do not exempt the customer from their obligation to allow sufficient time for travel, check-in, security checks, and other procedures at the airport.<\/p>\n<p>5.2 A timely arrival of the customer at the airport is <strong>not contractually agreed<\/strong>. myParkplace is not liable for missed flights, missed check-ins, missed security checks, or any other consequential damages resulting from the customer arriving too late.<\/p>\n<p>5.3 Upon return, the customer is obliged to follow the collection procedures communicated by myParkplace. If myParkplace requires a telephone notification or other contact after landing or after baggage collection for the return journey, the customer must comply with this duty to co-operate.<\/p>\n<p>5.4 If arrival, flight or return details are provided incorrectly, incompletely or late by the customer, this may lead to delays or additional costs. There is no entitlement to immediate collection in these cases.<\/p>\n<p>&nbsp;<\/p>\n<h2>6. Special journeys \/ additional shuttle services<\/h2>\n<p>6.1 The shuttle service included in the booked tariff fundamentally covers the agreed outward journey from the business premises to the airport and the return journey from the airport to the business premises.<\/p>\n<p>6.2 Additional shuttle or special trips requested by the customer or necessitated by circumstances within the customer\u2019s sphere of influence shall be charged separately.<\/p>\n<p>6.3 myParkplace is entitled in such cases, <strong>For an additional special trip, a flat rate of \u20ac20.00<\/strong> to calculate. This applies in particular when:<\/p>\n<ul>\n<li>the customer wishes to be returned to the car park after being transferred to the airport,<\/li>\n<li>the customer discovers after the transfer that items or documents have been left behind in the vehicle and an additional journey is therefore necessary,<\/li>\n<li>if the customer requires an additional collection or extra journey contrary to the communicated return dates or procedures,<\/li>\n<li>a flight is missed or the customer wishes to use an additional transfer service for other reasons not attributable to myParkplace.<\/li>\n<\/ul>\n<p>6.4 Further costs are reserved if, in individual cases, a significantly increased expenditure arises and the customer has been notified of this before commencement.<\/p>\n<p>&nbsp;<\/p>\n<h2>7. Prices and Payment<\/h2>\n<p>7.1 The prices stated or agreed at the time of booking shall apply.<\/p>\n<p>7.2 Payment can be made, depending on the booking channel and availability, in particular as follows:<\/p>\n<ul>\n<li><strong>Online<\/strong> regarding the payment methods offered in the booking system, such as PayPal, Mollie, credit card, or other payment types,<\/li>\n<li><strong>on-site<\/strong> by EC\/Debit card, credit card or in cash,<\/li>\n<li><strong>via intermediaries<\/strong>, if the booking is made via a partner or intermediary platform and has already been paid for there.<\/li>\n<\/ul>\n<p>7.3 If an online payment is envisaged at the time of booking or chosen by the customer, the total price is due upon completion of the booking or at the time specified in the booking process.<\/p>\n<p>7.4 Where payment on-site is agreed, the total price is due at the latest upon arrival at the company premises.<\/p>\n<p>7.5 Additional costs, particularly for special trips, exceeding the booked parking duration, or other supplementary services requested by the customer, are due for immediate payment.<\/p>\n<p>7.6 All prices are inclusive of the applicable statutory value-added tax, where applicable and unless expressly stated otherwise.<\/p>\n<p>&nbsp;<\/p>\n<h2>8. Cancellation, Rebooking, No-show<\/h2>\n<p>8.1 <strong>Standard free cancellation<\/strong><br \/>\n14 Tage vor dem geplanten Ankunftstermin kostenlos stornieren. <strong>24 hours before the booked arrival time<\/strong> Cancel for free.<\/p>\n<p>8.2 <strong>Cancellation within 24 hours \/ No-show<\/strong><br \/>\nUpon cancellation <strong>less than 24 hours before the booked arrival time<\/strong> or in case of non-arrival, no refund of payments already made is possible, unless mandatory legal provisions stipulate otherwise.<\/p>\n<p>8.3 <strong>Optional \u201e100 % money-back guarantee\u201c<\/strong><br \/>\nDoes myParkplace offer a separately selectable option as part of the booking process? <strong>\u201e100 % Money-Back Guarantee\u201c<\/strong> If the customer also validly adds and books this option, the customer may cancel the booking free of charge up to the booked arrival time, deviating from section 8.1, in accordance with the conditions stated for this during the booking process.<\/p>\n<p>8.4 <strong>Rebookings<\/strong><br \/>\nRebookings are only possible subject to availability and after prior agreement with myParkplace. myParkplace reserves the right to charge appropriate surcharges or discounts for rebookings in accordance with the amended booking.<\/p>\n<p>&nbsp;<\/p>\n<h2>9. Parking duration \/ Exceeding booked parking time<\/h2>\n<p>9.1 The customer is obliged to remove the vehicle from the operating premises no later than the end of the booked parking period.<\/p>\n<p>9.2 If the customer exceeds the booked parking duration, myParkplace is entitled to recalculate the additional parking days or the additional period according to the tariffs applicable at the time of actual use. <strong>However, for each additional calendar day commenced, a charge of \u20ac10.00 will be applied.<\/strong><\/p>\n<p>9.3 Furthermore, myParkplace is entitled to assert outstanding claims arising from exceeding the parking duration before the vehicle is handed over or before exiting.<\/p>\n<p>9.4 A tacit extension of the contractual relationship shall not occur. Section 545 of the German Civil Code (BGB) is excluded.<\/p>\n<p>&nbsp;<\/p>\n<h2>10. Use of the premises \/ Conduct on the premises<\/h2>\n<p>10.1 The regulations of the Road Traffic Act (StVO) and the instructions of myParkplace personnel apply throughout the myParkplace premises and at all entrances and exits.<\/p>\n<p>10.2 The premises may only be entered and used for the purpose of parking or collecting the vehicle, and for using the shuttle service. Remaining on the premises beyond this is not permitted, unless expressly agreed otherwise.<\/p>\n<p>10.3 Vehicles must only be parked in designated and allocated spaces. If the customer parks their vehicle outside the allocated or permitted area, and this causes an obstruction or inconvenience, myParkplace is entitled to move or tow the vehicle at the customer's expense, where necessary.<\/p>\n<p>10.4 The following are particularly prohibited on the premises:<\/p>\n<ul>\n<li>parking of vehicles that are not operational or not roadworthy,<\/li>\n<li>the parking of vehicles with significant leaks, particularly from the tank, engine, or cooling system,<\/li>\n<li>the storage of flammable, explosive or otherwise dangerous substances,<\/li>\n<li>the carrying out of repairs, oil changes, cleaning work or other work on the vehicle,<\/li>\n<li>any avoidable nuisance from noise, dirt or other disturbances.<\/li>\n<\/ul>\n<p>10.5 The customer is liable for all contamination or damage to the operating premises caused by themselves, their accompanying persons, or their vehicle.<\/p>\n<p>&nbsp;<\/p>\n<h2>11. Customer's obligations regarding the vehicle<\/h2>\n<p>11.1 The customer is obliged to park the vehicle properly and secure it adequately against rolling away and unauthorised use.<\/p>\n<p>11.2 When leaving the vehicle, the customer must in particular:<\/p>\n<ul>\n<li>to lock the vehicle correctly,<\/li>\n<li>Close windows and sunroofs,<\/li>\n<li>To switch off the lights and other electrical consumers,<\/li>\n<li>to secure the vehicle in the usual way for traffic.<\/li>\n<\/ul>\n<p>11.3 By entering the business premises, the customer assures that:<\/p>\n<ul>\n<li>the driver holds a valid driving licence,<\/li>\n<li>for which valid third-party liability insurance exists,<\/li>\n<li>the vehicle has no obvious safety-related defects that pose a danger to the operating premises or other vehicles.<\/li>\n<\/ul>\n<p>11.4 myParkplace is entitled, in appropriate cases, to request the production of a vehicle registration document, driving licence, or other proof, insofar as this is necessary for the performance of the contract or for the prevention of danger.<\/p>\n<p>&nbsp;<\/p>\n<h2>12. Liability of myParkplace<\/h2>\n<p>12.1 myParkplace shall be liable without limitation in accordance with statutory provisions<\/p>\n<ul>\n<li>for damages arising from injury to life, body or health,<\/li>\n<li>for damage resulting from intentional or grossly negligent breach of duty by myParkplace, its legal representatives or vicarious agents,<\/li>\n<li>as well as in the case of mandatory statutory liability provisions.<\/li>\n<\/ul>\n<p>12.2 In cases of slight negligence causing a breach of essential contractual obligations (cardinal obligations), myParkplace shall only be liable for damages that are typical for the contract and foreseeable. Essential contractual obligations are those obligations the fulfilment of which makes the proper execution of the contract possible in the first place and the observance of which the customer may regularly rely on.<\/p>\n<p>12.3 Further, liability on the part of myParkplace \u2013 subject to clause 12.1 \u2013 is excluded.<\/p>\n<p>12.4 myParkplace shall not be liable for any damage caused by other customers, other third parties, force majeure, natural events, vandalism, theft, burglary, fire, storm, hail, flooding, strike, official measures or other circumstances for which myParkplace is not responsible.<\/p>\n<p>12.5 myParkplace shall not be liable for any items, valuables, documents, technical devices, luggage or other contents left behind in the vehicle, unless myParkplace has acted with intent or gross negligence.<\/p>\n<p>12.6 To the extent that employees of myParkplace or commissioned third parties move or reposition the customer's vehicle on the company premises, this shall only be done if it is necessary for the performance of the contract, the organisation of parking operations or for safety reasons. The customer's claims shall remain limited to cases in which myParkplace is liable in accordance with these terms and conditions and statutory provisions.<\/p>\n<p>12.7 Any discernible damage or complaints must be reported to myParkplace immediately, preferably before leaving the premises.<\/p>\n<p>&nbsp;<\/p>\n<h2>13. Customer Liability<\/h2>\n<p>13.1 The customer shall be liable for all damages caused by them, their fellow travellers, accompanying persons, agents or their vehicle on the premises, to myParkplace's facilities, to shuttle vehicles or to third parties.<\/p>\n<p>13.2 The customer shall be liable in particular for damages and costs caused by leaking operating fluids, technical defects, or inadequately secured vehicles.<\/p>\n<p>13.3 The customer is obliged to report any damage caused to myParkplace immediately.<\/p>\n<p>&nbsp;<\/p>\n<h2>14. Lien \/ Right of Retention<\/h2>\n<p>14.1 myParkplace is entitled to a statutory lien on the vehicle and its accessories deposited pursuant to the contractual relationship for its claims arising from the contractual relationship, to the extent legally permissible.<\/p>\n<p>14.2 Furthermore, myParkplace is entitled to refuse the handover of the vehicle or exit as long as outstanding claims from the contractual relationship have not been fully settled, insofar as this is legally permissible.<\/p>\n<p>&nbsp;<\/p>\n<h2>15. Opening Hours \/ Operating Procedures \/ Availability<\/h2>\n<p>15.1 myParkplace endeavours, as a general rule, to provide its services reliably in accordance with the booked times and operational procedures.<\/p>\n<p>15.2 Actual operating procedures, particularly shuttle intervals, waiting times, pick-up times, and opening hours, may change due to operational reasons, traffic volume, flight operations, weather, official regulations, or other circumstances.<\/p>\n<p>15.3 If the customer disembarks in a country different to that stated in the provided data, or at an airport other than Berlin Brandenburg Airport (BER), there is no entitlement to collection at another location without a separate agreement.<\/p>\n<p>&nbsp;<\/p>\n<h2>16. Data Protection<\/h2>\n<p>16.1 myParkplace processes the customer's personal data exclusively within the scope of statutory data protection regulations.<\/p>\n<p>16.2 Further information on the processing of personal data, the service providers used and the rights of data subjects can be found in myParkplace's privacy policy in its current version.<\/p>\n<p>&nbsp;<\/p>\n<h2>17. No right of withdrawal for consumers<\/h2>\n<p>17.1 Where the customer is a consumer, the booking of a parking space and related services from myParkplace for a specific date or period shall generally <strong>no statutory right of withdrawal<\/strong>.<\/p>\n<p>17.2 This applies particularly because these are services related to leisure activities or time-sensitive services for which a specific appointment or period is planned (\u00a7 312g(2) no. 9 of the German Civil Code (BGB)).<\/p>\n<p>17.3 Consequently, when booking a parking space with a fixed arrival and departure period, the customer is generally not entitled to a statutory right of withdrawal.<\/p>\n<p>&nbsp;<\/p>\n<h2>18.
